Signing an NDA and braking it is serious. You can't juist break contracts.
I mean, if you leak stuff, use a burner account and distance yourself in as many ways as possible from it. I mean just use a decent VPN on a randomly generated email account, on a new discord account. The VPN shouldn't be able to provide any details if you use the right ones, they're designed that way. If you're being super cautious, VM, privacy focus Linux distro, strip all details from the images, VPN, create email account, free trial a different vpn, and log in on that one while connected to the other VPN, get discord account, post images. Or just says fuck it and YOLO on TOR.
Even then Nintendo probably knows who had access. They could probably determine who it is from the number of people who have access.

Shouldn't even be a crime.

Very different indeed. If he was given it early then dude broke NDA and he would be fucked. If he obtained it early then he broke the street date which is a problem that Nintendo have to sort with the retailer not the dude.

Discord doesnt encrypt its chats like Whatsapp?

Whatsapp couldnt comply to the authorites even if they tried.

Private user information, logs and details can be gained from Discord. Especially, if the user in question was reckless about how they approached this. Its happened before.

By the way, I'll bet you $10 that Whatsapp stores sensitive user data that could lead to identify you upon request.

People who leak confidential information should face consequences. Hopefully they nail this guy.

That is NOT how this works. The only way they can "get" this person is if the work was obtained illegally. Nintendo certainly has control over HOW their IP is engaged with (e.g. with takedown notices and the like that they love using), but they can't just make certain things a crime - certainly can't make civil ones criminal (as some folks in here seem to think).

Someone from Nintendo or someone who produces these booklets likely gave some other person a copy, and he then leaked it.

Nintendo is most likely not trying to punish this guy, but to find out where the leak comes from.

There is nothing "gray area" about it when an individual signs an NDA. Signing NDA means you legally agree to not break any rules in the document. If you've broken the rule then you have legally breached the contract and the company has every right and should either sue you or sent you to jail. No one forced you to sign it. They signed it, broke it and now have to face the consequences. This is really not rocket science.

All the way to years of jail time for sharing some artwork online. Never mind where this individual is located or what law is applicable in his/her country of residence...

Nintendo are fantastic assholes and the way they shit on their fans is quite epic to see.

Leaks are annoying as fuck for any major business, but unless you're trying to hide something, they're more of an inconvenience than anything else. People gunning for a hyper wealthy corporate body to chase down and punish individuals though... hope you never accidentally wind up on the business end of a big corpo's ire, forced to bend over and take it all the way to the hilt because even if you're in the right, you don't have the money or power to fight back.
