More attention on file sharing

Friend of mine alerted me to something that went down recently. His sister's friend's friend DLed some movie from a P2P proggie. Unbeknownst to him, it turned out to be kiddy porn.

Now the bad part - some authority DLed the file from him. The guy noticed the transfer and deleted the file immediately but it was too late. Fired from job, court date, kiddy porn rehab, possibly copyright charges.

Scary eh?

I wonder what would be the best thing to do, admit to copyright infringement or take the kiddy porn charge (although that would probably result in both).

He should cop to downloading and pirating movies and stay as far as he fucking can from the child endangerment shit or he might be registering his address for the rest of his life. He should get a good lawyer fast.

Conspiracy theorists at my high school used to talk about how the government took out and discredited dissidents by sending them child porn in the mail, and then busting them for it. I don't necessarily buy into that story, but with the internet it would certainly make the whole thing a lot easier.....some FBI guy can just hack your machine and plant the files on there.

I doubt that they are going to give him a choice between copyright infringement and child porn, particularly if they have hard evidence of both.

And this thread should scare most p2p users. Especially if you use kaaza. Good thing I get my music from either bittorent or iTunes. Other then that I only d/l fansubs-- also on bittorent.

ok wait wouldn't the guy have a good defense if ONLY that file was found on his PC? Also, if the file's name is something like "hell_boy_movie," then wouldn't that also help him?

Meh. All of this kind of siliness can be avoided.

One huge red flag that came to mind is.. why is he sharing files? I mean seriously, if you're using something like Kazaa or WinMX or something with a large userbase. As rude as it may be, just don't share. This keeps people from finding out if you have such files, or other illegal material. Bittorent and other clients are more understandable as you have to upload or you're really cheating the system, but you also have a very very minute chance of getting the wrong file.

Secondly, don't be a dolt. I know how some people can just come across such files, but it's really not that hard to avoid bad files. Know what you're looking for. Look at the file name, description, search terms. Viruses, and hoax files are so obvious. The file size, and descriptions give them away. Kiddy porn? What file was he looking for that would cause someone to switch this in? It's just rather hard to believe.

And when all else fails. Preview the file while it's downloading. Kazaa has this feature, use it. You can find out if a mp3 is bogus, or if a video you're downloading isn't what you wanted before it's done. Kazaa Lite even has an AVI previewer for that problem as well. Though I do realize that certain files can cause problems (mainly WMV/ASF), those you just have to play it safe by going but what I meantioned above.

I hate to say it, but these little things shouldn't scare people off. It should wake them and tell them to use some common sense on the internet. I'm sorry about your friend's friend friend or whoever, but if people would just take the time to think. Such problems can be avoided or even prevented.

My cousin was busted for kiddie porn in a similar way. He didn't want the pain in the ass to DL movies from Kazaa so he started a "virtual FTP hosting" service on IRC. Basically if you want to run an FTP server but have a shitty connection you have that option. For my cousin's side he just sits back and people upload all sorts of shit to him. He'll go through the files once a week or so and take what he wants and then delete the account. Mind you this was a few years ago when 3mb transfer rates didn't exist yet and no BITtorrents yet.

Anyways I guess he was monitored or something cause FBI came and took all his computers and shit and he's been in court for the past year or so and I think he was sentenced recently. I don't know many details these days as my uncle doesn't talk about it. The info we do get is through public court transcripts.

Scary? I think it's hilarious. But seriously, it must suck to be in that guy's position right now. Good thing I never use Kazaa anyway, I don't trust the content I'm downloading off that thing. And Kazaa is for newb pirates anyway :p

What is the legal term Actus Rae I think. Which basiclly would mean this guy is completely safe. What he did is not a crime at all.

Also this story is complete garbage.

Haha well his friend went to our school so there is a direct link to him. I just happen to not know him but my other friends do. It's plausible.
