On a second read this sounds worse than before.
Whereas before it sounded like resale would be permitted universally, albeit through Microsoft's drm-ed up system, it now sounds like there are two possibilities: not allowed at all, or through that same system. Depending on the publisher.
MS not taking a cut on trades is a concession, but there'll still be a fee to be paid by retail, to publishers. Business terms are between pub and retail.

Even if they'll accommodate the big pubs that want it with some PS3-like method (small pubs may opt out if given the choice or if Sony does it PS3 DRM-style, I think, just like the small ones stayed away from online passes etc.), unless it was an online game (like an MMO or the online portion of a game), wouldn't it have to be a more roundabout DRM method rather than this since Sony's got a lot more markets with very limited internet, hence their already making sure to get the word out that internet is not a PS4 requirement?
