From the all powerful GIZMODO:

Apparently Apple's none-too-keen on music video channel Fuse's new outdoor advertisements which mimic the iPod silhouettes campaign, replacing Apple's dancing music fans with people enjoying a nice pull of the beer bong or a casual round of self-pleasuring (suggested word: self-plaguing). The Post is reporting (haha, sorry, "reporting." That just kills me.) that Apple's lawyers have made a few nasty calls Fuse's way, threatening a lawsuit unless the ads are taken down.

So what, Comedy Central did this too. They used a similar campaign with dancing redneck shadows for their Redneck Weekend.

The poster should say, "Just like MTv, but we actually play that trendy pop shit non-stop instead of reality television 23 hours a day.

Since copyright law prohibits the substantial use of a copyrighted work without permission of the copyright owner, and because such permission is highly unlikely when the use is to create a parody, it may be necessary for the parodist to rely on the fair-use defense to forestall any liability for copyright infringement. However, the fair-use defense if successful will only be successful when the newly created work that purports itself to be parody is a valid parody.
