And they actually got something out of that case, the judge ruled against them, but he also mentioned that burgeoning markets can be monopolized, I predict we will %100 see that shit get used against Microsoft on cloud gaming.

Also a big part of the FTC case against Meta was that they would develop their own fitness app to compete with Within’s, but if the purchase proceeded they wouldn’t need to do this, removing a competing product from the market.

The judge ruled against that saying that while Meta was a large company with a lot of resources, the idea they’d develop their own fitness app was speculation.

And this is the argument against MS acquiring ABK - MS already has its own GAAS shooter. So the Meta verdict sets the precedent for the MS-ABK deal to be blocked.

There’s no arguing MS can’t build its own FPS when it already has one. A GOTY no less!

Basically FTC asking the court to force MS and ABK to produce documents that the FTC says are being withheld.

Not of major interest really but this does refer to zenimax again - the gift that keeps on giving.

Oh and one part of the request is specifically for documents relating to post acquisition plans for content that MS doesn’t want to hand over.

3 - documents around cross-play
6 - documents related to MS next gaming "ecosystem" (a part of console, subscription and cloud gaming business)
11 - documents around the exclusivity strategy behind Zenimax content and ABK content
16 - documents behind the deals with Nintendo, GFN and others

ABK RFP's
1 - consumer preference document around console choice.
2 - documents around cross-play
5 and 7 - documents around ABK offering/not offering content on MGS and Cloud services
8 - documents about the 'purported cannibalization' of B2p by MGS service and consumer behaviour differences between B2p and subscription users.

Doing this on my phone so it's a bit short in terms of my summary points

Xbox puts plenty of effort into building its own IP, it's just very difficult to build IP that's massively successful.

Just look at all the major third party publishers struggling to do it.

There's a reason why reboots, remakes, and sequels of the few IP's that were massively successful continue.

People forget Sony was trying so hard to build something as successful as Halo and Gears of War in the 6th and 7th generations until they found a successful formula from Naughty Dog that's extended to the rest of their studios and has been massively successful for them.

Why would they though?

Most of these cloud deals are for BYOG types, meaning that they will only result in more sales for MSFT on existing storefronts.

Whoever is cutting these deals is a very good strategist tbh. Microsoft has vastly improved in that regard compared to the Ballmer years.
 
sony opposing to the deal is making the industry better. Just look at how many deals is MS making to appease regulators.

So, all these green influencers and their minions that say sony is pathetic, whiny, etcetera need to recognize thay we came from MS offering just 3 more years only to sony, to access and parity for 10 years to everyone.

I wonder if Phil is going to take the "high Road" and thank Sony for forcing access to videogames to more and more people.
 
No chance in hell Microsoft is trying to make ABK exclusive to only Microsoft, as that would devalue the purchase. Sony is being a little bitch when it comes to these deals.

Microsoft are bringing cod to more players through niche cloud gaming providers that barely anybody uses? What? Who the fuck is ever gonna play fast paced multiplayer games through the cloud?

The same arguments for and against Zenimax games staying or not staying multiplatform would apply though. The only difference is scale. But that difference creates more incentive to make COD console exclusive down the road, because the goal remains the same.

Never forget that only Sony is allowed to have exclusives. That is what this whole thread and anyone in opposition to this deal truly believes.

Need I remind you that originally they were only offering Sony a deal to honor existing contracts? There were no offers/contracts with Nvidia, Nintendo, Valve, etc.

This good guy facade has only come about because they are desperate for this deal to go through in order to save themselves the embarrassment, and in some people's cases, their jobs.

Correct, streamed. Ubitus, for instance, is a service that has the infrastructure for companies that want to stream games. Their game partners include Capcom, Codemasters, Konami, Deep Silver, Sega, Ubisoft, Square Enix, and now Microsoft. Chances are, they license out to their Business Partners, such as Nintendo, Samsung, Vodafone, Sega, Microsoft, Jio, and so on. There appears to be a market for it and Call of Duty isn't the only game ABK owns. So who cares?

The more Microsoft gives up under pressure of getting the deal blocked the better for everyone.
None of this would have happened if it wasn't for this pressure they're feeling.
But I think there's room for more and they will be asked for more.
10 years is not a solution to anticompetitive concerns, it's just a delay. It needs to be monitored so that it's correctly enforced. It needs to have the possibility to get extended if the concerns are still valid in the future.
Hence why CMA want structural remedies.
We'll see what happens in the next few weeks.
