the guy who made the fan ome has said the big n can have translation for free.

There's a whole legal world there (especially because it's Japan). Translations from works are still derivative works? Nintendo can't license something that's not been licensed for translation. It's like Nintendo sending a cease and desist letter to some Zelda fan game or fanfiction and then publishing it themselves.
