Put a figure down, because at above $65 per share in a buyback the shareholders are being defrauded if Kotick agrees to an extension without a better price per share, And there is no way ATVI shares will be below $65 without a buybackm never mind a buyback from a $12b of cash, and fantastic business figures are coming that everyone knows is coming
If they agree to extension, they will get above 4.5b or more. That is more than 3b.

Of the three regulators who could theoretically stop this merger, EU passed with some remedies, CMA blocked and the FTC got rolled over in court..

The FTC is fighting as much as they could, but they failled, the "tough" CMA blocked which should be the end of all this, but no to Microsoft, they put so much pressure on the CMA that they caving.

I think Microsoft could buy Take 2 without much a issue because

EU doesn't care, since Xbox is insignificant in the region

CMA got spooked

and the FTC gonna get rolled over again in court.
Or the ftc case was weak. And as you stated Xbox has a small presence in Europe so no reason to stop the merger. Lastly the cma got political pressure and might make a deal.

I can’t say whether MS will push this through without CMA approval, but I’m saying CMA will not bow down to political pressure. And that’s what makes this so interesting for me.
They already have though.

Or at least they suspected they would lose in trial, but appeals rarely work so no reason to think that with the information we have

Nope.
If both party agree to extension, that means a new price point which can statisfy everyone.

They don't expect to lose at all. but they are required to use that as a last resort, and are legally required to return to negotiations, even with a bad actor like Microsoft that have no intention of appeasing the SLC properly.

Even if the cma does give in or whatever they will still look like they did there job, made ms give something up maybe fine them held the deal up etc… they won’t come out looking soft imo

They arent legally required to negotiate. The time to negotiate was before they blocked this.

What they are doing now is unprecedented.

And there are only two explanations for it.

1) They thought they could lose on appeal

2) Lobbying works

It is not, because it would weaken their appeal defence case with the CAT if they weren't prepared to lower the burden on the judiciary and tax payer to find an amicable resolution, if one could be found.

Lol no. There is no lobbying in the UK Civil Service, and if it was to happen, then careers are on the line. All UK Civil Servants work to the Civil Service Code;

Yeah I guess this is meaningless words to you, but it’s the core values of the Civil Service. Nobody in CMA is going to be lobbied by MS to get this deal through. And Sunak can bitch all he wants at them but it won’t change a thing.

Money is money. 70 Billion money for a Company like Activison is a dream come true. their market share is fish in the water and they know it. they do not have the foundation to justify that market share. ONE Bad Cod game and they will tank.

I stand by what I said, this deal will close by Monday ( Just My guess )

I don't know what you mean by "put cod on MS servers" but they have done a lot of work on the 360-era game servers last week, very likely in anticipation of this and them getting a new audience on game pass.

Top brass and their lawyers do the decision. If shareholders agree to it, the negotiation becomes effective.

Isnt CMA changing their stance about the block deadline?

It is an alternate universe article because everything they wrote about the CMA is factually wrong. Not least the final paragraph suggesting the CMA's powers are being reduced from this deal interaction, when they are being given more power and expanding by 250 staff currently.

The article is at least 50% hopium.

There's been no shortages of articles of this type about any organization that opposes the deal. I figure it's wiser to just wait and see what happens at this point.

I'm not bitter at all, I'm just a life long gamer that won't willing support the detriment of my preferred hobby., but you are welcome to support the demise by consolidation if that's how you like your gaming.

No it doesnt. Today the CMA announced they extended the date for the final order by the latest august 29th, and they are currently in discussions with Microsoft on a solution.
