Atmos on Headphones, along with Sonic, Tempest and DTS X, all simply use an algorithm that uses HRTF to try and fake the sound to sound atmospheric. Update 1703. Before that, Dolby for Headphones.The license is for emulating Atmos with non Atmos devices. It's been like that since Windows 10 released.
If you have a Atmos receiver it will work without paying anything else because decoding happens at the device and they already paid the license.
I think it's OK because it lowers the cost of the headset and allows people to choose to pay if they are interested in having emulated Atmos on their headset.
Going by many previous threads I've seen in GAF over the years, most people don't care.
I'm not making excuses for things that were once included at one time.

The differentiator is whether or not this middleware is a necessity or an extra. If MS didn't have Windows Sonic as a 3D audio solution, I'm sure they would have included Atmos for headphones by default (and ate the cost). Just to support the feature and be competitive with rivals.

I noticed a difference in both Cyberpunk and Gears 5 when I used the trial, which is what convinced my to purchase it when it was on sale.I guess a more relevant topic would be do users that pay for Atmos for headphones find it to be superior to Windows Sonic in games that support Atmos.

It's definitely not false advertising.I browsed their product page. At the very bottom there is a disclaimer that some options may require a subscription. I will not call this false advertising as a result. I still find it concerning though, because the subscription train keeps getting longer and faster.

I'd completely agree with you if someone was bundling a controller that you couldn't use until you payed an extra fee, but that isn't the least bit comparable to the topic of this thread (nor would ever happen in real life, LOL).
If you were looking for something analogous to this headset/Atmos situation, try something like back buttons. Both Sony and MS could just include a controller with this feature, but they want those extra $$$ and have discovered that buyers are willing to pay. Even this isn't perfect, because here MS and Sony directly benefit, in the case of Atmos for headphones, MS makes a few dollars on the transaction at most.

Sony again, eh?You can't even see that your baiting. As has been mentioned dozens of times, the headset works out of the box with Microsofts own codec. Like Sony, they have included their own codec which works out of the box.
Unlike Sony, MS has given its customers options to have Atmos or DTS, which those companies charge for. But instead of seeing the option as a good thing.... You've baited and made it look bad.

Also it is a feature I don't use since on the phones it seems like an equalizer and I am not a fan of those. Especially if all they do is add V shape sound to my perfect frequency
