So, is it better for me to just bring the console back to a Gamestop and return it? I don't want to have to keep a console in box forever because one day Gamestop may take me to court.
I am not a lawyer by any means but this is their mistake and I find it extremely unlikely it would be worth them paying someone to go around and collect their fuck ups. If the sum was high enough and they sent you like...100. Maybe.

ALso you could donate it to one of us that didnt get lucky.

Actually, in the US you're allowed to keep any "unsolicited package" that anyone sends you. It's a consumer protection that stops companies from sending you items then charging you for them after the fact. Gamestop could "ask" for the console to be returned, but you would be under no obligation.

In order to either get the Xbox or money back from you, Gamestop would need to take you to court at this point.
I think its questionable that this would count as unsolicited since an order was presumably placed. It seems more like a run of the mill mistake to me, which would entitle GS to its product back as long as they paid the freight. But whether they can charge a CC for it is a different matter, and they may be limited to suing for the return or payment for the device. It's an interesting fact patter to say the least.

As an aside, I can't believe people made this public so fast. If the few people who got the "deal" stayed quiet, this might never have come to light. Wasted opportunities.

They wouldn't be able to sue if they sent more than the order quantity. If an order was placed for 2 and they sent 3 then they they're not allowed to charge for the third one nor are they entitled to get the product back. Federal law considers that a gift. They can request it back and if you feel as though you should return it then the shipper also has to arrange for return shipping. But you definitely don't have to give it back.

I hope you're not referring to this thread. Regardless of how bad GameStop is handling this, I find it hard to believe they wouldn't investigate the discrepancy within a week.

I talked to my CC and they said they have to wait ten days after I file a dispute to reach a verdict but the lady I talked to, I told her the story, and she said its really strange and cant comment but that I should call back at the ten day mark.

I have attempted to reach out to GS customer service as my order has now disappeared. They are trying to claim they fixed the order and I wasn't charged.

yeah but I don't want the other one I want the $10 one :LOL: they seem to just be super backlogged so maybe I'll give it another week and see what happens... worst case scenario I just return everything or call GS after the holidays

Anyone who got their free extra S wanting to sell it? I'm willing to pay $150 USD + shipping (to Australia). Comes out around $210 AUD, which is around what I'm willing to pay for an S ($199 AUD).

I think it shouldn't be on longer than 10 days, mine was gone 5 days after I cancelled. Technically GameStop can leave it on there indefinitely.
A retailer doesn't actually remove a pending charge. When they authorize the transaction they do an authorization to see if funds are available. They may or may not do a request to settle. If they don't do a request to settle then the pending charge will fall off based on the policy of your bank. If they do then the funds will actually withdraw, typically within 48 hours.

What GameStop does is an authorization with the recurring flag set. That's what allowed them to retain a token to go back and charge people multiple times. There's lots of people who complain online that they see recurring charges from GameStop and it confuses them. They like to let the pending charge fall off and then do a recurring payment later.

has anyone tried making a return of the full price one to GS? When starting a return I can select either one, but I'm just nervous the associate will ring it up and pull some fuckery if I return to the store, but I'd prefer to do that rather than sell third party.

Finally my account was approved. 😂

Been lurking the thread for a while. Unfortunately I wasn't one of the lucky ones. I got the $300 regular Series S but the $10 one was returned to sender literally THE DAY it was supposed to be delivered. Gamestop emailed FedEx and told them to ship it back to them lol.

Was charged $334 + a mystery $49 charge which I have since gotten removed from my account. I also received the 3 months of Game Pass and $10 off coupon via email.

Just make sure to check your credit card and make sure GS doesn't try to retroactively bill you. And if they do, call your CC company and tell them to cancel the charge as you only agreed to the initial deal (with receipt proof). And not to any extra charge they tacked on later.

For those of you who have never had to call your CC to ask for help, they are great and look out for you. If a vendor tries to scam you they will cancel the charge. I had them do it myself for a shady plumber who billed me $150 and never fucking came back to fix my pipes. Guy came by, charged me and said he'll come back. And he never did. Never answered my calls. Jackass too as I even had the receipt. So whats the point of scamming me?

Called my CC company and told them the issue, they saw the charge, I showed them receipt for proof. And poof the charge was reversed a week or so later as they always need time to do some back end work looking into it.

Finally got the account approved. I got the bundle XSS through LSO ( horrible company, another long story to talk about later). The order number on the packing slip is totally different from the original order ( which it was canceled by GS). Also, the slip said 299+ 5k tax = 6k. Yep. It’s crazy. Not sure what to do now!

I'm all for capitalism and companies making money. But I'm also for people getting the deal as stated.

No doubt the deal was a mistake, but if the company allows it to go through, thats on them to fix and cancel. I think the deal was active all weekend when people noticed. So it's on them to fix.

I dont think anyone cares if they canceled the order.

But the key thing which I think is a total BS move is anyone getting retroactively charged for the extra system which looks like some people did.

You cant do that.

You cant run a furniture store saying buy the sofa and get the loveseat for free, and then after people buy it say it was a mistake and the love seat is regular price and then charge everyone's credit card an extra $500 two days later.

Except your example isn’t even close to what happened. They advertised buy something expensive, get something cheap at a discount. Somehow there was a glitch that made it buy an expensive item, get another unbelievably cheap where you basically had to know about the mistake to take advantage of it.
Some people got the deal, others didn’t. They should have cancelled everything but didn’t. And has anybody actually been charged and had the payment go through for the extra system? All I’m reading about are holds that are being processed.

It doesn't matter what the original deal was supposed to be. Either way they messed up. So if some people want to roll the dice and hope the deal goes through, cant blame people for that.

Not only retroactively billed, but getting billed for something we didn't even order. Phantom charges for a Game Pass code we were supposed to get for free for the mistake.

I agree that they cannot retroactively charge for it.

At the same time, this deal was never stated. It was a technicality/glitch in the shopping cart. Intentionally taking advantage of a mistake for something that much money is lame. The Series S was never advertised nor stated to be free for this deal, it was just a backend error being taken advantage of by people who were informed about the mistake.

For something inconsequential perhaps, but for a $300 game system? Example, I had no problem asking Target for Xenoblade Chronicles 2 for $20 because they advertised the Torna DLC at that price in their weekly ad...with a photo not of Torna but of the the actual XC2 base game, which misled me. I didn't realize the photo was an error until I was already at the store about to pay for it. In this case someone made a mistake but it resulted in an obvious "deal as stated" and I simply asked if they would honor it.

That is not quite the same as manipulating a shopping cart to make it create a discount due to a back-end error that was never advertised erroneously or otherwise, for a $300 item, racing to get in before they fix the mistake. I just thought about what a huge headache and even ass reaming this is causing for poor shmucks working at Gamestop and could not in good conscience attempt it.

After watching this thread. I am never ordering anything from gamestop EVER!

It's a risk dealing with them in any capacity.....has been for a long time.
Shifty used car dealership is the vibe I've had for years.......
Though I'm sure thier is exceptions/good people in some stores/areas.

I get what you are saying but their handling of the situation shows incompetence throughout their systems. I doubt this false on one person.
