Private emails and texts can also be depending on the severity of the legal implications of a trial. Murder, assault & battery, rape, child abuse, etc..Not company emails. If a company is served with a subpoena they must hand over all relevant requests that are granted.
So this was a fun little activity for the past week. After listening to most of the case bar today, I can't see how MS doesn't win this case and I predict they will.
Phil should have been the FTC's primary witness target, but they could never fully nailed him.
The one thing I did gather from this is that Sony better prepare for a fight, because MS for the very first time is going on offense in the console market. Sony will also for the first time be in a situation where they will have a few less studios to pump out content than their competitors something they never had to deal with.

They are trying to dominate other markets Sony isn't in right now. Tencent isn't in console and they make the most money. Microsoft is just tryna get a piece of that action. At the end of the day... not matter the outcome, it's pretty clear gaming is kinda fucked, like we'll get a good 4-6 years when all is said and done.
But with all documents and emails and depositions etc it's pretty clear things are gonna get crappy before they get any better and by that time I'll be in my 40s. Think I'll be OK with giving up the Controller then.
It's going to get nasty and whatever precedent is set here (most likely that nothing is going to stop Microsoft from doing what they want and be regulated) is going to have lasting effects on the industry.
Either studios are just going to die because they can't sell with stricter rules or Microsoft are just going to outspend their competitors from the market to create essentially a stranglehold (which they've confirmed is their goal)..

I think people are making too much out of the conflict of interest thing.This is one of those situations where everyone knows claiming victory before the decision might be crow dinner in a few days. It's kind of a mind screw in some ways.
For example, we have a judge in Northern California (pro tech) with a son who works for a party. Sounds great for MS. But she was appointed by Biden, UK blocked on cloud grounds, and both EU and Canada had concerns over cloud. That fact pattern does not exactly scream "let the corporation close before federal agency does full review."
Another example is that the primary focus of many who are in or follow the industry, seems to mean nothing to the people who make the decisions. But the part that most people saw as an afterthought now seems to be the make or break issue for the people in charge.
One thing is for certain though. Specifically, I can't be the only person who thinks "F the cloud", but if that cloud keeps me a step away from having to buy hardware or a subscription to play Duty, then bring on the thunderstorms!

I think the entire console focused part of the industry could be cooked if this happens. Opinion may change if telecommunications and streaming technology advance enough. But short of that, taking away performance and graphics due to bandwidth issues will send a lot of people looking for new things to do with their time IMO. I think that was analogical thinking. She compared buying games vs GP to Prime digital purchase and Netflix.
No one made it clear that where gaming differs is in response times - especially for cloud based delivery.
So I think she went away with the idea consoles are like DVD players - basically dead and everyone will migrate to digital delivery.
And she could be right in that - technology could develop to the point there is little or no qualitative difference in the experience through the cloud.

Because people are conditioned based on "convenience." And as us gaming dinosaurs get older and die off, the gen z's and ones after them grow up with instant access to digital goods. Some platform makers will hold out longer than others, but the writing is sadly on the wall.So our human history with videogames suggest that every company that has focused on making consoles and cares about the console business has found a great way to succeed and has lead in the industry over the last 35 years. Yet it's the one company that wants to go away from hardware, that's always in "last place". Even MS said they lost the console war. They lost it with the OG Xbox and the X360 too.

If Starfield didn't move consoles or subs to GP, then I could see Starfield being later released on Playstation. As it stands though, Starfield has proven "great games sell consoles".
A new customer in the Xbox ecosystem is worth more than 1 lost sale on Playstation. Undermining Starfield's exclusivity (which has already proven to be a success) would raise doubt in future customer's purchasing decisions.
