thats untrue. they can close. meta closed giphy even before CMA approval.
if the CMA appeals fails, MS has options. you heard about the ones about activision carving out the UK, yada yada yada
or they'll let the CMA take them the court, just like the FTC did.
Maybe Meta didn't have listed as a mandatory condition in their acquisition agreement deal.

Also, MS and ABK won't leave the UK. To move their UK teams isn't like to move a gifs website company. And to avoid the UK market for MS and ABK pretty likely would be more difficult than to Giphy because you know people in UK like their Government uses Windows, Excel, etc.

She's just pointing out the fact that Sony plays this same exclusivity game, yet is crying foul about what Microsoft might do if they are allowed to do... what Sony is already also doing. I guess?

They basically laid out their whole playbook in those emails. If this deal fails they will go buy IOI, Sega, FromSoft, CDPR, etc from that list. 70Bn tied up in Activision might be a good thing because it will prevent them from buying devs that core gamers actually care about for a bit.
Oh so they're going to walk into Japan and buy not 1 but 2 of their top publishers? Good luck with that.

Using it to establish baseline about exclusives, moved onto call of duty already.

If Sony bought Square Enix and made it exclusive I’d understand, it’s been established by Jim Ryan that he doesn’t think Starfield being exclusive isn’t anticompetitive which is another single player RPG. There is no game exclusive to PlayStation that is COD level.

Just saw a game advert on TV and the advert says in quite big letters at the end: Not available on other platforms until December 2023.
It's just a timed exclusive like FF7R, after that date it's up to Square.
So much fuss over timed exclusivity.
that is for Pc, but not xbox.

And you know this based on what, exactly? FF XV barely sold on Xbox One; Square-Enix had a million business reasons to skip Xbox for successive installments with no input from Sony required.
Barely sold? The only number we have is launch week UK physical sales were 21% on Xbox One. Which is not far off from the PS4 attach rate if you consider the install base. Especially considering the PS4 Pro launched in the exact same month.

Christ. So much focus on console when that's a losing battle. It was the moment the CMA wasn't convinced. Either the FTC has a plan to weave this into a great closing argument, they don't give a shit and just want this for case law, or they are truly incompetent.

It's been said that the CMA approval requirement can be waived by MS since it was in their agreement between each other.

Different needs for each regulator.

One has the power to simply ban, the other needs to prove that 'imminent harm' will happen.

V. Hard to prove imminent harm on a nascent platform like Cloud.

Judge just asked why he didn't analyse Call of Duty by itself instead of the whole of Activision. Since CoD is the only game that is being brought up for these "so called" issues. Judge said CoD is a unicorn in gaming and that you never know which game could be a "breakout" hit.

I highly doubt that. The only place it was close was the USA and even there it was getting outsold. Especially considering this was the month the PS4 Pro & Slim launched. Pretty sure in the UK it's 2:1, which is still better then EU 5:1.
