She should press charges to the full extent. He should be perma banned for the first incident, never mind a second.

well then you believe this should be a lifetime ban, because he did it twice.

Twice as in this is the 2nd unrelated occurrence where this has happened or literally twice in a span of a few hours? You called him a known repeat sexual predator, but everyone including the victim is treating the incident as one event, not two.

In what universe is a 1 year ban 'fine?'

What message does this send to every victim of sexual assault at every FGC event going forward? 'oh don't worry a year off and it'll all be out of his system, trust us!'

I don't particularly care if other people are viewing this as one event, he sexually molested her twice, after being told to stop and given a second chance. Who cares if it happened "only" a few hours later, the guy already got a second chance and fucking blew it.

as long as he gets the proper legal punishment its fine that its 1 year ban
The game is his livelihood so taking that away as well as the legal repercussions seems like maybe you're just ruining 2 peoples lives instead of just the victim

If you don't believe in rehabilitation and that people are just good or evil, then you're whats wrong with the world

This is the same bullshit defense that kid that raped that girl in college like 2 months ago gave and it's bullshit.

You just said you don't drink. You don't even know what it's to be drunk or black out drunk. I have been and many others in this thread have been drunk on many many occasions and even black out drunk. I sure as hell hope that they are like me and never thought about crawling into a bed with someone and touching them when their fucking boyfriend is right next to them.

Where on earth, in my entire comment, am I DEFENDING the guy? I have said in every single comment in this thread that he should be punished and held accountable for his actions.

The second part was in response to some comments of people saying alcohol had no affect on your brain or thought processes, you don't have to be a drunk to know this isn't true. There are a myriad of studies that show alcohol affects a persons brains in different ways specific to each person (which is why you get drunks that can be happy, some aggressive, etc).

You make the choice to drink though, and thus if you do something (like this, or drinking and driving) you reap the punishment you deserve for making that choice in the first place. That is why people can't use the "I was drunk" as a defense, it's a poor excuse.

Also I knew full well the affects of drinking from first hand experience, it's a part of my life I do not like to discuss and I am keeping it that way, so don't assume that because I myself don't drink means that I know nothing about it or what it can do to people.

1 year? Like really? and the young lady that this happened to doesn't want to make a big deal out of it?

Man it's circumstances like these that don't reinforce it's a big damn deal. Dude got a slap on the wrist, he reputation tarnished, and etc. Nothing is ever a fair trade for what happened to the victim.

Was thinking the same thing. Ban for life, out is only a videogame tournament and he tarnished it anyway.

lol yes, it's not the guy who repeatedly sexually molests a woman that is wrong with the world, it's the guys calling for a harsher punishment. Sure.

its not a black and white case of "this person is evil, and will always be evil"
people are held accountable for their actions, but we also need to understand why these things happen on more than a superficial level

Considering what he did was punishable by actual jail time, him being banned for just 1 year with no charges is just annoying. Hopefully the woman wasn't pressured into dropping the charges. He should count himself lucky and take steps to figure out why drinking alcohol makes him want to molest women

You don't care that the victim is seeing the incident as an entire event? Ok.

He should be banned for life.

"Rehabilition" and "Be a better guy" can be done without him being in the Smash community anymore.

He can pursue other interest. Heck, no one can forbid him from, say, playing Smash online with other people. Just ban him from the professional community.

Evilness has nothing to do with this. He is dangerous, based on his past actions.

I don't care what problems this guy has in his head. By all means, go get help. Nobody is saying he isn't damaged. But he should not be allowed at such an event anymore, because his actions have been proven to be extremely dangerous.

I do not put a person's ability to earn money while playing video games over the risk that another person might have their lives destroyed.

A) You are putting words in the victims mouth. By her own admission, she claims she was sexually molested twice

B) your entire argument is some twisted form of appeal to authority. Why would it matter if the victim sees her two sexual molestations as one event or not? The contention is that he committed sexual molestation twice, thus making him a repeat sexual molester.

One Year is a joke. If you want to give the guy a chance to rehabilitate, it should be closer to 3 to 5 years, an actual time frame for the guy to maybe grow up and learn something. And that's likely being far too light, this likely needs a more serious punishment.

A one year ban is insufficient. Permanent from the jump. This is sexual assault.

There isn't enough side-eye in the world for some of the statements up in here.

Her reason for not charging him is that she doesn't want this to define her and she believes pressing charges could lead to some sort of backlash that prevents her from achieving her life goals.

So sadly, yes, societal pressure is keeping her from pressing charges. A woman should not have to choose between her life goals and seeking justice.

im assuming he doesn't have a criminal record, correct? well he should have one now
if the community has decided on the extra measures then thats not your say now is it.

but but but what if he's a good guy?! Shouldn't he continue to draw a paycheck from paying video games???? Really, he's the one who needs sympathy here. You're just a part of the problem.

And so forth and so forth.

One year is definitely not enough. I believe people can be rehabilitated but that doesn't mean I'd want my future children in the same room as this guy. If that makes me a bad person oh well.

I'm out. It's obvious you are looking for a fight and I'm not interested in having one especially with the subject matter being something I have experienced myself. You win.

Excuse me, am I not a part of the video game community? Seems to me plenty of the "community" disagrees with this.

Yeah I'm the one with the problem, not the attempted rapist. How dare you put her fate on me, by the way.

His livelihood can continue after he's rehabilitated, and to me the series of denials and his obvious concern for his ability to keep playing a fun video game for a living take no precedence over the safety of his victim and anybody else who comes into contact with him.

It's amazing how priorities get shuffled when it comes to sexual crimes. "Hey hey now let's not forget about this guy's career or anything. Let's not be monsters about it!"

So wait, you prefer just the victims life be ruined? And think his ability to play a video game at a tournament is more important then the right of every women in attendance of these events ability to feel safe?

EVO has no obligation to give him rehabilitation, they are not the federal government or apart of the prison system.

I have a firm belief in dudes like this changing and genuinely learning to not be shit bags. I'm studying counseling and specifically counseling male perpetrators of abuse, and I know guys can change. But that doesn't mean he's entitled to any forgiveness or generosity. He fucked up, and he needs to be accountable and deal with the consequences. He needs to show years of commitment, the kind of proof that someone has changed that can only come with time. He's especially not entitled to any space that the survivor is going to be in.

So yeah, lifetime ban, unless the survivor herself allows otherwise.

You keep going back to this notion of good or evil, you sure it's not you who is caught up on that? Because you can check this thread, and I'm certain you'll find the only people who ever bring up the notion of evilness are those who are going to bat for this guy.

No, the word we're using here is dangerous. Because he is. Because he committed sexual assault twice.

They shouldn't have used Capcom's 1 year ban as a baseline for THIS incident. As much as both harassment are disgusting, there is a difference in severity between "feeling a grope" and "jumping into bed with her and shoving your hands into her shirt and panties". This warrants a much harsher penalty.

its her decision to not press charges, even if they really should happen. You want to fuck up two people just to make it "even"? what about all the people that are close to him? it should be more important to prevent this kind of thing from ever happening than to go on witch hunts and talk about wanting to kick him in the head (which would make you just as bad)

if you believe people are simply good or evil, then yes, you have a serious problem.

How good or evil he is doesn't enter into the conversation. He's simply dangerous ahd should be kept away from an environment where he's demonstrably proven incapable of restraining himself.

Get off your damned high horse.

The impression a one-year ban gives me is that they do not take sexual assault as seriously as they should.

Another chance should be earned, not freely given. He squandered the only one he deserved when he twice molested this woman.

Should be lifetime. Revisit it after a time period much longer than one year if he can prove somehow that he is rehabilitated, not a danger to fellow attendees and deserving of the privilege. Burden shoild be on him.

One year is disgusting.

You realize this guy being allowed into tournaments after only 1 year is a danger to other people's livelihoods, right?

No, of course you don't.

Further, if I go to a company party and sexually assault a co-worker, I'd expect to, bare minimum kiss my job goodbye. What makes this guy so untouchable? Why is it that he deserves to play video games for a living? If he can get good at a video game, he can probably do lots of other jobs. Fuck, go dig ditches for all I care.

the whole one chance mentality

Actually, this is his third chance now.

dude "drunkenly" copped a feel and got off scot free. At that point if that's the game you're playing, you won. He proceeds to do it again after they handwaved it away? Oh hell nah. Dude should be facing charges, forget EVO. 5 year ban on top of whatever his jail time is.

Tournament organizers can still institute harsher bans than the one year one. For example, I highly doubt that Mr. Wizard will ever allow this guy back at EVO.

What about the guy actually being criminally prosecuted? That seems like a much higher priority right now.
It's complicated. Sometimes survivors of sexual assault don't want to put a huge blemish on the perpetrator's life. Like, the guy's life would be ruined for at least a few years, and they don't want to put that on him. They might not forgive or forget, but they'll give some generosity and not press charges. Maybe the survivor in this case has similar motives, or maybe it's something totally different. I don't know, but it's her call.

its her decision to not press charges, even if they really should happen.

This is true

You want to fuck up two people just to make it "even"?

His punishment is just a time out in comparison to what she'll have to deal with, so yes I feel a little weightier of a penalty is required. Also, him not being able to play a video game is not "ruining his life". He can still get a job somewhere since this won't be on his record.

what about all the people that are close to him?
What about them?

it should be more important to prevent this kind of thing from ever happening than to go on witch hunts
2 things:
-Don't change the subject to prevention when your whole speal before this was "rehabilitation"
-You can't witch hunt someone who is already found and admitted to doing it

talk about wanting to kick him in the head (which would make you just as bad)

Quote when I said this

what high horse are you talking about here? legal action should be taken, but a permanent ban for something that is your entire livelihood and passion seems medieval to me

Your emotional appeals to how much he needs to play video games for a living is really bizarre, as is your willingness to look down on people who think the 1 year punishment is weak as hell. I care for his livelihood about as much as I care for any other attempted rapist. Get some perspective and try engaging with what's being said instead of pretending I made it out to be about good and evil and oh won't someone please think of those perpetrators of sexual assault.
